Change of Investment registration certificate for project operating under Investment license, Investment certificate or other documents of equivalent legal value

a) Implementation order:

- Step 1: The investor submits 01 set of documents for the request for change of Investment registration certificate to Department of Planning and Investment.

- Step 2: Department of Planning and Investment issued Investment registration certificate for change to the investor within 03 working days from receipt of the documents as provided in Point a Clause 1 of Article 61 of Decree No. 118/2015/ND-CP.

Investment registration certificate re-defines the content of investment project in Investment license, Certificate of investment preferences, Investment certificate or other documents of equivalent legal value. In case the Investment license, Investment certificate or other documents of equivalent legal value is Business registration certificate, the content of business registration at Investment license, Investment certificate h other documents of equivalent legal value continue to be effective.

b) Implementation method:

- Submit documents: directly at the Division of receiving and returning results (in the head office of the Department of Planning and Investment in Hung Yen province); or through the postal system.

- Receive results: directly at the Division of receiving and returning results (in the head office of the Department of Planning and Investment in Hung Yen province); or through the postal system.

c) Documents:

- Written request for change of Investment registration certificate (Attached with Report on the project implementation by the time of change of Investment registration certificate);

- A copy of Investment license, Certificate of investment preferences, Investment certificate or other documents of equivalent legal value.

* Remarks: Individuals/ organizations implementing administrative procedures may submit the copy from the original, certified copy or copy not certified and the original for comparison

Within 03 working days from receipt of the documents.

e) Implementing agency:

- Agency directly implementing administrative procedures: Department of Planning and Investment in Hung Yen province;

- Coordinating agency: relevant departments, lines.

Investor (individual and organization) owns investment project operating under Investment license, Certificate of investment preferences, Investment certificate or other documents of equivalent legal value.

h) Results of administrative procedures:

Investment registration certificate under Form II.4 issued together with Circular No. 16/2015/BKHDT.

k) Name of form, declaration:

- Written request for change of Investment registration certificate under Form I.12 issued together with Circular No. 16/2015/BKHDT.

- Report on implementation of investment project to the time of adjustment under Form I.8 issued together with Circular No. 16/2015/BKHDT.

l) Requirements and conditions for procedure implementation:

- There is valid record.

m) Legal basis of administrative procedures:

- Investment Law No. 67/2014/QH13 dated 26/11/2014;

- Decree No. 118/2015/ND-CP dated 12/11/2015 of the Government detailing and guiding the implementation of some articles of the Investment Law;

- Circular No. 16/2015/TT-BKHDT dated 18/11/2015 of the Ministry of Planning and Investment providing the form of investment procedures and investment report in Vietnam.
