Supplement and update of enterprise registration information

a) Implementation order:

·    The company is responsible for the supplement of missing information in the enterprise registration documents when changing enterprise registration content including the following information: phone number, fax number, electronic mail address (email), website of the company. The supplement of phone number of the company in the enterprise registration dicument is required. Where the company does not supplement the phone number of the company, then registration documents of change in enterprise registration content are considered as invalid under the provisions of Clause 15, Article 4 of the Enterprise Law.

·      The company is responsible for update, supplement of information in the Enterprise registration certificate, enterprise registration documents under the provisions of Clause 7, Article 8 of the Enterprise Law, as follows:

a.    Where the company only updates and supplements information about the phone number, fax, email, website, the address of the company due to change in the administrative boundaries, information on the identity card, the address of individuals in the Enterprise registration certificate, the company sends the Notice on supplement and update of Enterprise registration information (Annex II-5 Circular 20/2015/TT-BKHDT) to the Business registration office where the company registered its head office. The Business registration office receives the notice and issues the Enterprise registration certificate to the company.

b.   Where the company only updates and supplements information in the Enterprise registration documents without changing the content of Enterprise registration certificate and not in the cases of notice on change of Enterprise registration content provided for in Article 49 to Article 54 of Decree No. 78/2015/ND-CP, the company sends the Notice on supplement and update of Enterprise registration information (Annex II-5 Circular 20/2015/TT-BKHDT) to the Business registration office where the company registered its head office.

The Business registration office supplements the information into the documents of the company and issues the confirmation under corresponding provisions in Decree No. 78/2015/ND-CP. In this case, the company does not have to pay.

b) Implementation method: The company sends the Notice on supplement and update of Enterprise registration information (Annex II-5 Circular 20/2015/TT-BKHDT) to the Business Registration Office where the company registered or via electronic network.
