Extension of investment progress

a) Implementation order:

- Step 1: The investor submits the written proposal for the extension to Department of Planning and Investment, including the following contents:

+ Operational status of the investment project and the implementation of financial obligations to the State since being issued Investment registration certificate or Decision on Investment Policy to the time of progress extended;

+ Explanation of the reason and the extended duration of the project;

+ Plans to continue implementation of the project, including capital contribution plans, capital construction progress and putting project  into operation;

+ Commitments of the investor on the continuation of the project implementation.

- Step 2: Within 15 days of receipt of the proposal, Department of Planning and Investment makes written comments on the extension of the investment.

b) Implementation method:

- Submit documents: directly at the Division of receiving and returning results (in the head office of the Department of Planning and Investment in Hung Yen province); or through the postal system.

- Receive results:

+ The Statement of Department of Planning and Investment in Hung Yen Province on requesting the extension of the project implementation (for projects subject to Decision on Investment Policy) or Legal instrument on extension of investment project (for projects not subject to Decision on Investment Policy): at the Division of receiving and returning results (in the head office of the Department of Planning and Investment in Hung Yen province); or through the postal system;

+ Document about extension of investment (for projects subject to Decision on Investment Policy): at the Archives of the Office of Provincial People's Committee; or through the postal system.

c) Documents:

- Written proposal for extension of investment project progress  under Form I.9 issued together with Circular No. 16/2015/TT-BKHDT dated 18/11/2015 (attached with the written Decision and Minutes of the meeting of the Board of Members/ Board of Directors/ General Assembly of Shareholders/ Company owner on the proposal of extension of the project implementation; Cpy of Business registration certificate, Enterprise registration certificate , Investment certificate or Investment license; Decision on Investment Policy (for documents of foreign organizations, they must be legalized; documents in foreign language must be translated into Vietnamese, certified by organizations with function of translation); Report on project implementation to the present time).

* Remarks: Individuals/ organizations implementing administrative procedures may submit the copy from the original, certified copy or copy not certified and the original for comparison.

d) Number of documents:

02 sets (01 original set)

đ) Time limit for settlement:

Within 15 working days from receipt of proposal of the investor.

e) Implementing agency:

- Agency directly implementing administrative procedures: Department of Planning and Investment in Hung Yen province;

- Coordinating agency: relevant departments, lines.

g) Subjects implementing administrative procedures:

- Investor (individual and organization) owning the investment project issued  Investment registration certificate or written Decision on Investment Policy and the investor proposing the extension of investment (progress of the investment capital, construction progress and putting main works into operation (if any); progress of implementation of the operational objectives of the investment project) compared to the progress specified in Investment registration certificate, written Decision on Investment Policy.

- In case of adjustment of progress of the project implementation stated in Investment registration certificate, written Decision on Investment Policy, follow the corresponding procedure for adjusting Investment registration certificate, Decision on Investment Policy, but do not follow this procedure.

h) Results of administrative procedures:

Document about extension of investment (Clause 4 of Article 46 of Investment Law) under Form II.7 issued together with Circular No. 16/2015/TT-BKHDT).

i) Fees:

None

k) Name of form, declaration:

- Written proposal extension of the investment project implementation (Clause 1 of Article 46 of Investment Law) under Form I.9 issued together with Circular No. 16/2015/TT-BKHDT;

- Report on implementation of investment project to the time of adjustment under Form I.8 issued together with Circular No. 16/2015/TT-BKHDT.

l) Requirements and conditions for procedure implementation:

- Investor extends the implementation progress of investment capital, the progress of construction and putting the main projects into operation (if any); implementation progress of the operational objectives of investment project compared to the schedule specified in Investment registration certificate or Decision on Investment Policy (Total time of investment extension is no more than 24 months. In case of force majeure, the time to overcome the consequences of force majeure is exclusive of time of invesment extension).

m) Legal basis of administrative procedures:

- Investment Law No. 67/2014/QH13 dated 26/11/2014;

- Decree No. 118/2015/ND-CP dated 12/11/2015;

- Circular No. 16/2015/TT-BKHDT dated 18/11/2015 the Ministry of Planning and Investment providing the form of investment procedures and investment report in Vietnam.
