On Establishment of the Center for Investment Promotion and Business Support directly under Hung Yen Department of Planning and Investment

HUNG YEN PROVINCE PEOPLE’S COMMITTEE

Pursuant to the Law on organization of People’s Councils and the People’s Committees dated November 26^th, 2003;

Pursuant to the Notice No. 853-TB/TU dated April 9^th, 2010 of the Standing Committee of Provincial People’s Committee on establishment of the Center for Investment Promotion and Business Support directly under Hung Yen Department of Planning and Investment

In consideration of the proposals of the Department of Home Affairs under the Statement No. 221/TT-SNV dated April 28^th, 2010,

HEREBY DECIDES:

            Article 1. To establish the Center for Investment Promotion and Business Support (herein after referred to as the Center) directly under Hung Yen Department of Planning and Investment

            The Center is a public non-business unit with incomes, a part of self-supported expenses for its operations, which functions to assist the Department of Planning and Investment in organizing and implementing the investment promotion operations in the province. The Center is governed, instructed, directly controlled by the Department of Planning and Investment and directed, guided, tested professionally by the State’s competent authorities.

            The Center has its own legal corporate, own seal and account for its operations.

            Its headquarter is located at the premise of the Department of Planning and Investment, No. 8, Chua Chuong Street, Hien Nam Ward, Hung Yen City, Hung Yen Province.

            Article 2. The Center has following rights and obligations:

            2.1 Obligations:

            a) To build the short-term and long-term investment promotion and business support activities of the Center on basis of the social – economic development programs of the province and the working plans of the Department of Planning and Investment to submit to the Director of the Department of Planning and Investment for approval and to organize implementation after the submittals are approved.

            b) To assist the Director of the Department of Planning and Investment in organizing implementation of policies, guidelines in investment promotion, investment activities, investment preferences, management, Official Development Assistance – ODA campaign, non-governmental foreign aids; to assist the business development;

            c) To help the Director of the Department of Planning and Investment to build the programs, 5 -year, annual plans on investment promotion, Official Development Assistance – ODA campaign, non-governmental foreign aids; to assist the business development in the province;

            d) To report to the Director of the Department of Planning and Investment about investment promotion, Official Development Assistance – ODA campaign, non-governmental foreign aids; to assist the business development in the province;

            2.2 Powers:

            a) To manage and operate the Business Information Portal to supply and receive online information to / from the organizations and individuals correctly under regulations and laws, to support the requirements on direction, management of the Provincial People’s Committee and the Department of Planning and Investment;

            b) To coordinate with the specialized agencies and authorities to build the social- economic information system and mechanism, policies on investment promotion, management, Official Development Assistance – ODA campaign, non-governmental foreign aids; to assist the business development;

            c) To organize the activities of market research, organization of professional trainings on investment operations, management, Official Development Assistance – ODA campaign, non-governmental foreign aids, business operations and business administration;

            d) To take charge of receiving the requirements on investment promotion, business development assistance for the units, agencies in the province, beyond the province in connection on investment promotion, business development assistance

            e) To organize the domestic and foreign investment promotion activities to introduce potentials, comparative advantages, preferential investment policies, investment environment; to organize propaganda, advertisement of investment activities on mass media; to introduce investment projects of the province with the investors; to supply other necessary information to the investors;

            f) To campaign, receive and implement the programs, projects on assistance and cooperation with domestic and foreign organizations under regulations and laws;

            g) To supply the services on investment assistance and to help the business development: to supply the services upon the investors’ requirements; to consult to prepare documents and to complete the administration procedures on investment, business registration; to consult the investors to select the specialized consultants with sufficient qualifications and capacity to make the investment projects; to consult the organizations, individuals to select the partners in investment, cooperation, negotiation, receipt of the projects under regulations and laws; to contact with the agencies, departments, units of the province and the Central Government to support the investors to carry out the administration procedures on investment and business incorporation; to support the investors to handle difficulties during the process of implementation of investment projects and business operations;

            h) To control the organization, regular personnel, to secure the salary payment mechanism and the policies on profits, preferences, trainings, fostering, rewards and compliments, punishment for the officers, civil servants and workers of the Center under regulations, law and decentralization of the Provincial People’s Committee;

            i) To control the use of finance resources and assets assigned under regulations and laws;

            j) To do other obligations assigned by the Director of the Department of Planning and Investment

            Article 3. Organizational structure of the Center consists of:

            a) The Leadership of the Center: the Director (is taken in charge by the existing Deputy Director of the Department of Planning and Investment at the same time) and 01 Deputy Director.

            - The Director of the Center shall bear responsibilities to the Director of the Department of Planning and Investment and to the laws for entire operations of the Center

            - The Deputy Director of the Center is the assistant to the Director of the Center, who is in charge of one or some fields assigned by the Director of the Center and bears responsibilities to the Director of the Center and to the laws for his assigned missions;

            - Assignment, re-assignment, rotation, rewards, complements, punishments, dismissal, removal from the key position, retirement and implementation of the other policies and mechanism for the Director, Deputy Directors of the Center are under the regulations and laws and personnel management decentralization of the Provincial People’s Committee. Appointment of the Director, Deputy Directors of the Center is based on the professional and specialized standards issued by competent authorities and regulations of the province.

            b) Regular personnel:

            - In short- term, to meet the work requirements, the Center is assigned with 5 regular personnel to help, work under the online professional and specialized mechanism of the Center;

            - The recruitment, arrangement, use and management of officers, civil servants of the Center shall base on the work demands, title, positions, professional and specialized standards and scale structure for civil servants and officers as stipulated by the State

            Article 4. The budget for the Center’s operations

            a) The finance source from the province’s budget

            The finance source for regular operations to carry out the functions, missions assigned to the Center is governed by the regulations for the non-business units supported annually by the Provincial People’s Committee from the province’s budget on basis of the cost estimate of the Center for the functions, missions, mechanism assigned and operation plans of the Center.

            b) The budget from the incomes created by the non-business operations of the Center as stipulated by laws and regulations.

            Article 5. This Decision has come into valid since signing. The Chief of Secretariat of the Provincial People’s Committee, the Director of the Department of Home Affairs, the Director of the Department of Finance, the Director of the Department of Planning and Investment, the Director of the Department of the State’s Treasury of the province; Head of concerned agencies and the Director of the Center for Investment Promotion and Business Support are responsible for implementing this Decision.
